Under Colorado Law, the
applicable statute of limitations is determined by the
nature of the action asserted. The following table is
a guide to the applicable limitations periods and should
not be substituted for the advice of an attorney. Please
be aware that the name of the claim action chosen by
the Plaintiff is not dispositive of the applicable limitations
period. Courts will look to the true nature of the action
regardless of the name used in the complaint. In addition,
Colorado law sets forth when a cause of action accrues
for each type of action.
| Assault,
intentional actions, battery, false imprisonment,
false arrest, liable, slander, specific fraud and
misrepresentation claims. |

Tort and Product Liability Actions
Tort actions (negligence, trespass, premises liability,
malicious abuse of process, outrageous conduct,
interference with relationships, tortious breach
of contract) (does not apply to any action arising
out of the use or operation of a motor vehicle),
strict liability, failure to warn, wrongful death,
and actions against public or governmental entities
(most). All negligence, breach of contract, or tort
action against a health care provider or institution.
Actions against architects, builders, engineers
and inspectors based on their professional services.
Product liability actions against manufacturers. |
2 Years |
Auto and
Contract Actions
Contract actions (including U.C.C. claims), most
fraud, misrepresentation, concealment, deceit, breach
of trust or fiduciary duty, Motor Vehicle Financial
Responsibility Act, Colorado Auto Accident Reparations
Act, all tort actions for bodily injury arising
out of the use or operation of a motor vehicle.
Uninsured or underinsured motorist actions (with
exceptions). |
3 Years |
Debt Collection
All actions to recover a liquidated debt, rent,
or unpaid retirement contributions. |
6 Years |
In addition to issues of the accrual dates, the statute
of limitations may also be tolled if the person is a
minor (under 18), mentally incompetent, or legally disabled.
