Personal Injury Damages

The following diagram depicts the categories of damages recoverable in personal injury actions in Colorado, including statutory caps, interest, and exemplary damages.

Total Verdict

Note that Colorado is a comparative negligence state with a 50% bar. This means that any negligence of the plaintiff decreases the damages he or she can collect by his or her percentage of fault. If the fact-finder assigns the plaintiff 50% or more of the fault, the plaintiff is barred from recovering damages from the defendant.
